Terms of Sales
ARTICLE 1: APPLICATION
These General Conditions of Sale apply to all sales concluded through the website www.up-station.com between a user of the site, hereinafter referred to as the Customer, and the company UP-Station whose the head office is located at 70 rue de Tilsit 13006 Marseille, hereinafter referred to as UP-Station.com.
Placing an order implies the Customer’s full and unreserved acceptance of these General Conditions of Sale. No agreement or commitment can, except formal and written acceptance of UP-Station, prevail over these General Conditions of Sale. Any clause to the contrary posed by the Customer will therefore, in the absence of express acceptance, be unenforceable against UP-Station.com, regardless of when it may have been brought to its attention.
ARTICLE 2: ORDERS
Only online orders are taken into account.
Once the order has been received and processed, a confirmation email is sent to the Customer with the package tracking number.
UP-Station. com reserves the right to cancel or refuse any order from a customer with whom there is a dispute over payment for a previous order.
ARTICLE 3: PRICE
The prices indicated are in euros and all taxes included in the country of departure, excluding shipping costs. They are subject to change. The items ordered are invoiced on the basis of the price in effect at the time the order is placed.
The price is payable in full and in a single payment when ordering. All orders are invoiced in euros and payable in euros. For any delivery outside France, any customs fees or local taxes remain the responsibility of the recipient.
ARTICLE 4: SHIPPING COSTS
The shipping costs include a flat-rate contribution to handling and shipping costs. They are the responsibility of the Customer and are invoiced at the end of the order in addition to the products selected. They are valid in the European Community. For any other destination, the amount of shipping costs must be agreed upon prior to ordering.
ARTICLE 5: PAYMENT
The Customer can pay for his order:
– by credit card (Stripe)
– by Paypal account
ARTICLE 6: PREPARATION OF ORDERS
Orders are generally prepared within 48 hours of receipt of payment. This period may be longer during periods of high activity or during school holidays. UP-Station.com makes every effort to reduce this delay as much as possible. In the event of late preparation, an email will be sent to the Customer. In this case, and as long as the order has not been shipped, the Customer may cancel their order which will be refunded in full.
ARTICLE 7: DELIVERY TIMES
Delivery is made by Colissimo within 48 hours from the date of posting (deadline in working days for shipments in mainland France subject to compliance with the deadline for posting), to the address of delivery indicated on the order, in France or in any country of the European Community.
UP-Station.com cannot be held responsible for the consequences due to a delay in delivery.
In case of delay delivery, the order having been shipped, the Customer can cancel it and request a refund as well as that of the return costs (within the limit of the cost of sending in standard mode). UP-Station.com will reimburse after receipt and control of the products.
ARTICLE 8: FACULTY OF RETURN
The Customer has 14 clear days from delivery of the order to return their items to UP-Station.com. The order will be, depending on the Customer’s choice, exchanged or refunded in full within a maximum period of 14 days, provided that the products are intact, without traces of use and in their original packaging. The Customer can return their order to UP-Station Returns 70 rue de Tilsit 13006 Marseille. Return costs are the responsibility of the Customer.
In the event of the return of an unclaimed, refused package or due to an incorrect address provided by the customer, the following will be done, according to your choice:
– either to the reimbursement of the order, after deduction of the shipping costs incurred and a lump sum of 10 euros for management costs
– or to the return of the order after payment of the shipping costs additional costs incurred.
ARTICLE 9: TRANSFER OF OWNERSHIP – TRANSFER OF RISKS
The transfer of ownership of the products to the benefit of the Customer will only be carried out after full payment of the price by the latter, regardless of the delivery date of said products. On the other hand, the transfer of the risks of loss and deterioration of the products will be carried out upon receipt of said products by the Customer.
ARTICLE 10: INTELLECTUAL PROPERTY
All text, photos, comments, works, illustrations and images reproduced on the UP-Station.com site are its property. Consequently, it is strictly forbidden to reproduce, download, copy, or even partially exploit them for commercial purposes and this worldwide without the prior consent of UP-Station.
ARTICLE 11: RESPONSIBILITY
The products offered comply with current French legislation.
UP-Station.com declines all responsibility if the delivered item does not comply with the legislation of the country of delivery.
UP-Station.com disclaims all liability in the event of breach of contract due to force majeure (strike, flood, fire, etc.).
ARTICLE 12: APPLICABLE LAW
All the clauses appearing in these General Conditions of Sale, as well as all the purchase and sale transactions referred to therein, will be subject to French law.
